YouNow is a video live stream where every person can watch live at any time. Especially for children and teenagers YouNow is extremely popular and they use it, without thinking about the dangers involved . They tell too much about their lives, reveal their real names, often their place of residence, even their cell phone numbers are often sent via the livestream into the world. A paradise for stalkers and pedophiles!
Lawyers now also warn against legal consequences: For many users are extremely careless not only with their personal data, but also with the personality and copyright of other people !
YouNow and the copyright
Often the teenagers have music playing in the background as they film for YouNow. Not infrequently, they even accept music requests from their viewers: "Hey, do you also have the new single from Mark Ronson and Bruno Mars?" - "Clear!" Nice for the users who can listen to their favorite music - even more beautiful for the GEMA. Because they can charge for it.
Specialist lawyer Karsten Gulden of GGR Rechtsanwälte warns on the side of his law firm : "Background music that is publicly streamed over the internet is subject to a fee and it does not change that you do it as a private individual and you do not make any sales with YouNow GEMA repertoires - that's the majority of chart music - have to be registered with GEMA, which can be expensive. "
So far, no case is known where the GEMA has reported to a user. But as well known as YouNow is by now, that's probably just a matter of time.
The personality rights of others on YouNow
Many users do not just film themselves in their own home. At the weekend, for example, they film at parties or during the week at school. But that goes to the personality rights of the other party guests, classmates and also the teachers who could be filmed. For most of the time the other friends, classmates and teachers do not know that they are being filmed and shown on the internet.
"This clearly violates the privacy rights of those affected, " explains Christian Solmecke, partner of the law firm Wilde Beuger Solmecke on the homepage of his law firm. "This could be injunctive claims on the young."
Tobias Röttger from GGR Rechtsanwälte adds on the side of his law firm: "Even the teacher can take legal action against such a livestream and the right to spoken words is violated and this can also end in a warning, not to mention other school disciplinary measures."
