These are your rights as a customer

Quite simply it is often not in practice. The most important rules for guarantee, warranty and exchange.

warranty

As a customer, you have a legal claim that a newly purchased item is faultless. The dealer stands straight for two years. Example: If the toaster does not work after four months, there is a defect. You can ask for a supplementary performance - replacement or repair. Even if you no longer have the box or the receipt, the purchase can also be evidenced by a bank statement or price tag. The dealer must rectify within a reasonable time, or send the device - at his expense. If the repair then, for example, dragged on for months, you can also withdraw from the purchase contract - goods back against purchase price.

exchange

It looks different if you want to exchange flawless things, because you like the toaster but not so much. Although traders are often accommodating and exchange their goods within 14 days, they are not obliged to do so. "That's why they can also set conditions and explain, for example, in the terms and conditions: Exchange only with original packaging, " says lawyer Stephan Roessler (Rosenheim). "You accept the terms and conditions automatically with the purchase. Ask for the exchange conditions."

guarantee

In addition, dealers or manufacturers can voluntarily grant a guarantee that the goods will not fail within a fixed period of time. The warranty period can be freely determined by the manufacturer or dealer.

compensation for use

If the customer returns the goods within the warranty period, the retailer may under EU law, demand no fee as compensation for use. The German legislature will take over the regulation in 2008. Until then: user fee pay only with reservation.
